1. Agreement to Terms
Please read these Terms and Conditions carefully before using the Y3K Brahmans website (https://y3kbrahmans.com.au). Your access to and use of the Service is conditioned upon your acceptance of and compliance with these Terms. By accessing our website, you agree to be bound by these Terms.
2. Communications
By creating an account or making an inquiry, you agree to receive newsletters or promotional materials from Y3K Brahmans. You may opt out at any time by following the unsubscribe link in any email we send.
3. Purchases and Payments
If you wish to purchase any product or service (including livestock or genetic material), you may be asked to supply information relevant to your Purchase, including billing and shipping information.
- Payment Facilitation: We use third-party services (Stripe/PayPal) for payments. By submitting your information, you grant us the right to provide this information to these third parties subject to our Privacy Policy.
- Order Cancellation: We reserve the right to refuse or cancel your order for reasons including product availability, errors in the description/price, or suspected fraud.
4. Genetics Sales & Logistics
- Final Sale: All semen purchases are non-refundable and carry no express or implied warranties.
- Transfer of Responsibility: The goods become the sole responsibility of the purchaser (Owner) from the moment payment is verified.
- Insurance Liability: The Owner acknowledges that Rocky Repro Pty Ltd does not provide insurance for stored goods or transit. Securing appropriate insurance coverage for loss or damage is the sole responsibility of the Owner.
- Freight and Storage: All storage fees incurred at Rocky Repro are the responsibility of the Owner. Furthermore, all freighting and forwarding costs must be paid in full before the release of goods from the facility.
5. Livestock Sales (Paddock & Private Sales)
5.1. Application of Terms
These terms apply specifically to the purchase of live animals (the “Livestock”) from Y3K Brahmans, including heifers sold directly from the paddock. These terms supplement our general Website Terms and Conditions.
5.2. Description and Inspection
- (a) While Y3K Brahmans makes every effort to provide accurate photos, DNA status (Polled/Horned), and Pompe status on the website, the Buyer acknowledges that livestock are biological entities and minor variations may occur.
- (b) Paddock Sales: For animals sold "from the paddock," the Buyer is encouraged to inspect the Livestock prior to purchase. If the Buyer elects to purchase without physical inspection, they accept the animal "as is" based on the provided digital records and descriptions
5.3. Pricing and Payment
- (a) All prices for Livestock are listed in Australian Dollars (AUD) and are exclusive of GST unless otherwise stated.
- (b) A deposit may be required to "hold" an animal. Full payment must be cleared in the Y3K Brahmans bank account prior to the Livestock leaving the property.
5.4. Risk and Title
- (a) Title: Ownership of the Livestock remains with Y3K Brahmans until full payment is received.
- (b) Risk: Risk of loss, injury, or death of the animal passes from the Seller to the Buyer at the "point of loading" onto the Buyer’s transport at the farm gate. It is the Buyer’s responsibility to arrange transit insurance if desired.
5.5. Delivery and Collection
- (a) Unless otherwise agreed in writing, the Buyer is responsible for arranging and paying for all transport from the Y3K Brahmans property.
- (b) Livestock must be collected within [e.g., 14 days] of full payment. Y3K Brahmans reserves the right to charge agistment fees for animals left on-property beyond this period.
5.6. Health and Reproductive Warranties
- (a) Health: Y3K Brahmans warrants that at the time of sale, the animal is in good health and has been managed according to standard industry biosecurity practices.
- (b) PTIC (Pregnancy Tested In Calf): If a heifer is sold as PTIC, it has been certified by a qualified vet or scanner. Y3K Brahmans does not warrant the successful birth of a live calf following the transfer of risk.
- (c) Fertility: Unless a specific fertility guarantee is provided in writing, Y3K Brahmans does not warrant the future breeding performance of maiden heifers.
5.7. Regulatory Requirements (NLIS)
- (a) Y3K Brahmans will provide a National Vendor Declaration (NVD) and complete the required National Livestock Identification System (NLIS) transfer on the database within the statutory timeframe following the physical movement of the cattle.
- (b) The Buyer must provide a valid Property Identification Code (PIC) before the animal can be dispatched.
5.8. Limitation of Liability
- To the maximum extent permitted by law, Y3K Brahmans shall not be liable for any indirect or consequential loss (including loss of profits or genetic potential) arising from the purchase of the Livestock.
6. Availability, Errors and Inaccuracies
We are constantly updating our offerings. Despite our best efforts, products (livestock, semen, or embryos) may be mispriced, described inaccurately, or unavailable. We reserve the right to change or update information and to correct errors at any time without prior notice. Y3K Brahmans does not guarantee the 100% accuracy of any information found on the Service.
7. Livestock and Genetic Material
Any purchase of live animals or genetic material is subject to health protocols and mandatory NLIS (National Livestock Identification System) requirements. Ownership and risk pass to the buyer as per the specific Bill of Sale or contract associated with that purchase.
8. User-Generated Content
If you post comments or content on our Service, you are responsible for its legality. By posting, you grant Y3K Brahmans the right to use, reproduce, and distribute that content. We reserve the right to remove any content that violates copyright or our community standards.
9. Accounts
When you create an account, you guarantee that you are above the age of 18 and that the information you provide is accurate. You are responsible for maintaining the confidentiality of your account and password.
10. Intellectual Property and Copyright
The content on this website—including images of our sires, pedigrees, and downloadable files—is the property of Y3K Brahmans. You may not reproduce, distribute, or reuse any content for commercial purposes without express written permission from us.
11. Limitation of Liability
In no event shall Y3K Brahmans be liable for any indirect, incidental, special, or consequential damages resulting from your use of the website or the purchase of livestock. Your use of the service is at your sole risk.
12. Governing Law
These Terms shall be governed and construed in accordance with the laws of Queensland, Australia, without regard to its conflict of law provisions.
